The fisher caught fishing only because of his Ukrainian name

The pond owner apologized to the fisherman and offered him the opportunity to fish with him. He never saw the man, he never had anything to do with him, he didn’t even have bad references on him from the fishermen’s association or from the operators of other bodies of water.

According to Křeček, it was clear discrimination

The fisherman fulfilled all the obligations given by law in order to be able to fish with him. The only obstacle to getting a permit was his Ukrainian-sounding name. The hostile attitude of the pond owner made the fisherman ask for the help of the public defender of rights.

“I came to the conclusion that the man was rejected on the basis of his name indicating a nationality other than Czech. This resulted in direct discrimination on the grounds of nationality in the area of access to services according to the anti-discrimination law,” the ombudsman told Novinkám. He decided to settle the dispute amicably.

Rybníkář later changed his mind

The fisherman’s protector explained that you can’t put them all in one bag, in other words, if you have experience with Ukrainian fishermen who didn’t follow fishing rules, you can’t automatically assign someone to them just because they have a Ukrainian name.

“I understand that the pond operator has had bad experiences with some fishermen and that their reckless behavior has caused him considerable damage, which he is trying to prevent. However, this cannot be a reason justifying the refusal of a person interested in fishing, if he himself has not committed a crime against fishing rules. To conclude that all persons with a certain name, accent or nationality will violate fishing rules is a prejudice,” the ombudsman added.
