Kosovo – The Constitutional Court temporarily restricts the work of the Assembly and the formation of the Government

The Constitutional Court of Kosovo has ruled that by the end of September, the Assembly should not take any steps to form the new government.

Due to the failure of the last vice president by the Serbian community, the Constitutional Court, by supporting the allegations of the MPs of this minority, announced on Friday that further efforts to constitute parliament should also be fully stopped by September 30.

The court stated that this serves to “avoid irreparable risks or damages” and is in “public interest”.

Although last week, the political class resolved a multi -month stalemate regarding the election of the Parliament, the issue did not go as expected by the voting of the vice presidents of parliament, namely that of the minority.

None of the candidacies proposed by the Serbian community received the necessary votes, but the new Parliament leader, Dimal Basha, considered that the non -election of the vice president from the Serbian minority should block the constitution of the Assembly.

This attitude of the Vetevendosje politician was contested by MPs of the Serb minority, who on August 30 addressed the Constitutional for “violating legal and democratic order”. They argued that with the failure to select their candidates, Parliament committed violations of the basic constitutional principles, such as equality before the law, the right to a regular process and the voting process in parliament itself.

The controversy over the constitution of the Assembly were the last few hours at the center of discussions between the Parliament Speaker Basha, the Head of the EU Office and the British Ambassador to Kosovo, where the Westerners emphasized the need to respect constitutional processes, for inclusive and multiethnic institutions.

Even the new Presidency of the Assembly, which was announced to meet this week with the four elected vice presidents, was boycotted by opposition representatives on the grounds that the Assembly was not consistent, unlike Mr. Basha.
