The new president of Kosovo must be elected before the new executive is created. In an interview for the news agency Kosovapress, the former president of the Constitutional Court of Kosovo, Enver Hasani, said that according to the fundamental law of the state and the obligations arising from it, after the constitution of the Assembly, the deputies must first deal with the issue of electing a new head of state.
“It is a constitutional rule. The last judgment of the Constitutional Court, paragraph 162, makes it crystal clear that whenever there is no president, that is, when the position is vacant, he is elected first. When, as the case may be. Then it’s sixty days and it continues… Judging by my experience, Mr. Kurti has not dealt with the Constitution or the law at all. He violated them in the most primitive way possible, which will be remembered in the political history of this country. He can insist and continue with the government, then with the president… If agreements are made, the other bodies are elected there. For once, the president in the morning, the government in the afternoon“, said Hasani.
The disagreement between the parliamentary parties on the election of the new president, after the end of the mandate of Vjosa Osmani, led to the dissolution of the tenth legislature of the Assembly of Kosovo and early parliamentary elections. For the election of the new head of state, three rounds are held in the Assembly. In the first two rounds, the candidate for the highest post of the state must receive a qualified majority of two-thirds or 80 votes from the 120 deputies of the Assembly, while in the third round a simple majority of 61 votes is sufficient.
For the process to be valid, at least 80 deputies must be present in the hall in all three rounds.
