Selimi stopped at the initiative of the Democratic Party of Kosovo to change the Law on Specialized Chambers and the Office of the Specialized Prosecutor.
According to Selim, the constitutional amendments do not allow the cancellation of the Specialized Chambers, but it requires the determination of where the process will end and Kosovo will not suffer further damage from the Specialized Chambers and the Specialized Prosecutor’s Office.
“Unfortunately, the Hague decision found Kosovo in a situation without institutions, after the elections and at a bad time, without a President. Kosovo’s constitutional changes do not allow such a drastic decision as the undoing of the Specialized Chambers, but the PDK demands constitutional changes, where two are the main points. The first is to know when the conclusion of this process is, which is a slope on the head of many of the founders of the KLA and those who have fought, and create a concluding framework. The second point is monitoring, where it is shown that the process had many shortcomings. They demand legal changes so that the PDK is withdrawn from the Constitutional Court and to prevent decisions in the future that may be incalculable”, he said.
Selimi called for the issue of the Special Court not to turn into another source of political polarization in Kosovo. He said that, despite the political differences, there is a common position between the position and the opposition regarding the need for legal changes.
“Wisdom and love are needed so that there is no polarization, blackmail and political calculations for benefits in the electoral elections around this topic. The position and the opposition have a common position regarding legal changes, but international partners should also be in the discussion,” said Selimi.
Speaking about the judicial process in The Hague, Selimi also raised concerns regarding the appeal of the decision, where the hopes for changing the decision are almost zero.
“On appeal, history has shown that 100% of the defense’s appeals have been canceled and 100% of the prosecution’s appeals have been accepted. This does not allow optimism for the future,” he said.
PDK has submitted to the Assembly of Kosovo the Draft Law for the amendment and completion of the Law on Specialized Chambers and the Office of the Specialized Prosecutor. The initiative comes after the conviction against the former leaders of the KLA, Hashim Thaçi, Kadri Veseli, Jakup Krasniqi and Rexhep Selimi, who were sentenced to 81 years in prison in total.
