The Constitutional Court of Kosovo publishes the full judgment, 12 days time MPs for the constitution of the Assembly

The Constitutional Court of Kosovo has announced the full judgment on the process of constitution of the Assembly of Kosovo, stressing that this process has stalled due to the non -election of the Vice President of the Assembly by the Serbian Community. According to the judgment, the court ordered the deputies to constitution the Assembly within 12 days.

In the ruling, the Constitutional Court stressed that MPs should exercise their constitutional function during the process of election of the Vice President of the Assembly from the Serb community, in accordance with the Constitution and Regulation of the Assembly.

The Court has recalled that “the constitutional provisions and judicial practice there is no obligation for MPs to vote for vice presidents in one package, but this can only happen if there is agreement between parliamentary groups”.

“Based on parliamentary practice for the election of vice presidents from the ranks of communities who are not a majority since 2011, vice -presidents from the deputies of non -majority communities have been voted and elected in packages. Assembly ”, reads the decision of the Constitutional Court.

This decision came after several months of political stalemate that has blocked the process of constituting the Assembly, following complaints from the Serbian List regarding the voting procedure of vice presidents from minorities.

In this way, the Constitutional Court has requested that the problem be resolved and the Assembly be constituted within the prescribed deadline, to enable the full functioning of Kosovo institutions.
