The Democratic Party of Kosovo (PDK) is officially considering the possibility of addressing in court the case related to the legal status of Albulena Haxhiu as acting president.
The statement was made by the Head of the PDK Parliamentary Group, Arian Tahiri, who raised serious legal dilemmas about the compatibility of this function after her election as a deputy in the Assembly of Kosovo.
According to Tahir, the party’s legal teams are preparing legal moves to clarify whether holding several positions at the same time constitutes a violation of constitutional norms.
“We have considered that Ms. Haxhiu is not the acting president because she is a substitute for the prime minister. It is right for us to turn to the Constitutional Court for the future as well, to clarify that when the acting president is voted as a deputy, he ceases to hold office, even if the position remains vacant.” said Tahiri.
Criminal charges and warnings for political resistance
In addition to addressing the Constitutional Court for the post of state leadership, PDK announced that it is also working on other legal steps against officials who exercise executive and legislative functions in parallel. Tahiri emphasized that criminal reports are being prepared for cases where, according to him, the duties of the minister, prime minister and deputy are being exercised illegally.
Regarding the political blockade and successive elections, the PDK representative criticized the approach of the acting Prime Minister, Albin Kurti, guaranteeing that the opposition will not accept conditions.
“You have the votes for the Assembly, you have them for the government, you can’t vote for the president because you don’t have all of them in hand. Therefore, every option is possible, it’s open, but let them forget that submission is an option for us. We will resist,” he underlined.
PDK underlined that the protection of the democratic functioning of institutions remains the main priority in this legal and political conflict.
