Haxhiu addresses the Constitution: Who exercises the powers of the President if the successor is not chosen?

The Acting President of Kosovo, Albulena Haxhiu, has addressed the Constitutional Court to seek clarification regarding the exercise of presidential powers, if the Assembly fails to elect a new President. The request was submitted on October 5, 2026 and is related to the end of Haxhiu’s six-month term as acting President.

In the request addressed to the Constitutional Court, among the main issues is the question whether Haxhiu can continue to exercise the presidential powers even after the end of this term and on what constitutional basis. According to Kosova Press, another issue that requires clarification is the announcement of early elections, in case the Assembly is dissolved due to the failure to elect the President. The Office of the President seeks to determine which authority will exercise this power under the circumstances.

According to the Haxhiu Office, its position is based on the principle of institutional continuity and the need for the functioning of institutions not to be blocked due to the end of a constitutional term. It is now expected that the Constitutional Court will give its interpretation of presidential powers and the procedures to be followed if Kosovo remains without an elected President.
