According to Alibal, the changes proposed by the PDK do not fundamentally change the nature of the law, which seriously infringes on the very sovereignty of Kosovo.
“It doesn’t seem to me that the changes that the PDK is seeking will change the nature of the law. The law is discriminatory and cements the limitation of Kosovo’s sovereignty in an exceptional way. It is about a Kosovo court that has no Albanians, but only foreigners, and that operates outside its territory. There are so many defects and violations of the principles of a regular process, that it seems as if the court has castigated this thing, so that later the Appeal will have the opportunity to overturn it,” he said
The analyst said that, in addition to developments in Kosovo, Albania should also have a role in the legal debate related to the basis for the creation of Specialized Chambers. He referred to the Council of Europe report of 2011, based on the statements of Carla Del Ponte.
“The task of the Albanian government is greater than that of Kosovo. The former must request the annulment or overturning of the 2011 CoE report and, the moment that report is overturned, the initiative or support of the law is overturned. Albanian prosecutors must open a criminal investigation against Carla Del Ponte, as her unfounded accusations are the essence of that report. The Council of Europe must apologize to Albania for approving that report, which was discussed also for the accusations about the ‘Yellow House’ in our country. This is a legal battle and it will be difficult to change the law for the Specialized Chambers”, he said.
