She stabbed her husband under the ribs. The Mongolian court confirmed the eight and a half year sentence

A woman who faced up to 18 years in prison for attempted murder will be exiled for eight years after serving her sentence. Originally, the regional court expelled her permanently. She pleaded guilty at the regional court and he accepted it. At the High Court, she demanded a lower sentence, by half a year, and also the cancellation of the sentence of expulsion. The eight-year sentence was proposed in the plea agreement, but the defendant rejected it at the regional court. It did not even include the penalty of expulsion.

“The punishment is not completely disproportionate, but the fulfillment of its purpose, or the correction of my client, is also possible in a milder way. She did not agree to a plea agreement because she did not fully understand what it meant for her due to the language barrier,” said the defendant’s lawyer. He also pointed out that her husband has forgiven her and intends to continue living with her.

In the case of a prison sentence, the Supreme Court did not accept the prosecution’s arguments, but partially did so in the case of expulsion. “The defendant did not accept the plea agreement. During the trial, the prosecutor proposed ten years, and she received eight and a half. This sentence is therefore legal and reasonable,” explained Libor Losa, chairman of the Olomouc High Court.

On the contrary, he described the penalty of indefinite expulsion as disproportionately severe. “Deportation as such is, however, appropriate. The defendant has no background in the Czech Republic, her husband only works here temporarily. His imposition within a defined scope is more appropriate,” stated the judge.
