“After the evidence, the court has doubts that the act happened as it is described in the indictment. Guilt was not clearly proven,” said the president of the senate, Emil Pešina. According to the court, the opinion of an expert was key, who called the woman’s claims about Rákosník’s aggressive behavior not very credible.
According to his words, the accused man had the feeling that the victim could offer him more sexually than his partner.
“He lured the victim out in front of her residence and persuaded her to get into his vehicle. He then drove about 400 meters to a place with little traffic, where he stopped and then forced the 21-year-old woman to perform various sexual practices by strangling and slapping her,” the indictment states, stating that the accused should have stopped his actions only when the girl started crying.
Before the court, Rákosník confirmed the meeting, including intimacy, but denied that he would use any violence. “We started kissing and touching each other. I certainly did not strangle or slap her,” the defendant declared.
According to his words, he already had one encounter with the victim in the past with an erotic touch. “I wanted to talk to her about whether we could do it again and also find out if we have feelings for each other. I had the feeling that she could offer me more than my current partner,” Rákosník continued.
But he definitely denied that he was rude and the victim did not like it. “It was mutual, we approached each other and had the first kiss. Then it escalated with kissing, which turned into sexual satisfaction,” continued the accused man.
When asked by the judge how he explains that the victim is talking about gross violence, he said that she did not want to look bad in front of her friend, who found out about their meeting. “She has a reputation as a promiscuous girl,” concluded Rákosník.
He considered it flirting
According to experts, the accused man has a narcissistic nature with a tendency to impulsive reactions without rational control. They also pointed out his contemptuous and superior attitude towards others.
“He perceived the meeting with the victim as casual flirting. He acted with her in a humiliating and even aggressive manner, which could have sexually excited him. He likes it when women perceive him as attractive,” the experts stated.
