The Constitutional Court of Kosovo has determined that the 60-day period for the election of the President of the Republic began on August 8 and ends on October 6, 2026.
The decision was taken this Wednesday, September 23, after examining PDK’s request regarding the evaluation of the constitutionality of the decision for the election of the President of the Assembly, the procedural decision for the way of voting for the vice-presidents, the finding for the constitution of the 11th Legislature, as well as the decision for the election of the Government.
The court has established that the Assembly of Kosovo was constituted after the expiration of the 30-day period defined by the Constitution. According to the verdict, the passing of this term has the consequence of the beginning of the flow of the constitutional terms for the election of the President, in the case when the position of the President is vacant, as well as for the formation of the Government.
However, the Constitutional Court has assessed that the decision of the Assembly of September 13, 2026 for the election of the Government of the Republic of Kosovo is not contrary to Article 95 of the Constitution, which defines the procedure for the election of the Government, calling it legal.
In the judgment, the Court also requested that the members of the Assembly, as soon as possible, elect the deputy speaker of the Assembly from among the second largest parliamentary group, in accordance with the Constitution.
